Velvet Morning - Terms & Conditions + Privacy Policy

1. Overview

Velvet Morning is a Calgary-based small business offering handcrafted brunch boxes and related food products, prepared in a licensed commercial kitchen and delivered directly to customers’ homes. Every item is made fresh with care, using high-quality, locally sourced ingredients.

2. Orders and Availability

• Orders can be placed through our official website (www.velvetmorning.ca), Instagram @velvetmorningyyc or through authorized direct contact with our team.

• All products are made in limited batches and may sell out before the order cutoff date.

• An order is confirmed only after full payment is received.

• We reserve the right to refuse or cancel any order due to unexpected circumstances (e.g., kitchen limitations, delivery constraints, or ingredient shortages). If cancelled, you will

receive a full refund.

3. Menu and Ingredients

• Menus may vary weekly and can change without notice based on ingredient availabilityor quality standards.

• Minor variations in color, portioning, or presentation are expected due to the handcraftednature of each box.

• Ingredients and potential allergens are listed on the product card provided with everydelivery.

• Despite strict precautions, Velvet Morning cannot guarantee an allergen-freeenvironment. Our kitchen may handle nuts, dairy, gluten, soy, and other allergens.

4. Pricing and Payment

• All prices are listed in Canadian Dollars (CAD) unless otherwise specified.

• We accept payments via secure online methods (e.g., credit/debit cards, Square, or approved platforms).

• Promotional codes, discounts, or gift cards must be applied at checkout and cannot be combined or applied retroactively.

• Velvet Morning reserves the right to modify pricing or discontinue products at any time.

5. Delivery Policy

• Deliveries take place within Calgary and select surrounding areas, typically on Sunday mornings between 7:00 AM – 11:00 AM, unless otherwise stated.

• Customers must provide accurate delivery details. We are not responsible for failed deliveries due to incorrect addresses or the absence of a recipient at the delivery location.

• Once delivered, the responsibility for the product transfers to the customer. Velvet Morning is not liable for spoilage, theft, or damages after successful delivery.

• If we cannot reach you during delivery, your box may be left in a safe location at your risk.

6. Storage and Consumption

• All food is prepared fresh and should be refrigerated immediately upon receipt.

• Consume within 24 hours for optimal freshness.

• Velvet Morning is not responsible for quality or safety issues arising from improper storage, reheating, or delayed consumption.

7. Cancellations and Refunds

• Due to the perishable nature of our products, all sales are final once the order has been prepared.

• Cancellations made at least 72 hours before delivery may be eligible for a credit or partial refund.

• In case of an issue with your order (e.g., missing or incorrect item), please contact us at info@velvetmorning.ca within 4 hours of delivery with photos and details.

• Each case will be handled individually with fairness and care.

8. Gift Cards and Promotions

• Velvet Morning gift cards and discount codes are non-refundable and cannot be redeemed for cash.

• They must be used before their expiration date and are valid only through official Velvet Morning channels.

• Lost or stolen gift cards cannot be replaced.

9. Privacy Policy

Velvet Morning values your trust and is committed to protecting your privacy.

This section outlines how we collect, use, and protect your personal information.

a. Information We Collect

We may collect the following types of information:

• Personal details (name, email, phone number, delivery address).

• Payment details (processed securely through third-party providers — we do not store full card numbers).

• Order history and preferences, for improving service quality.

• Communication data (emails, messages, or feedback provided voluntarily).

b. How We Use Your Information

Your data is used only to:

• Process and deliver your orders.

• Contact you regarding order updates, delivery confirmations, or product issues.

• Improve menu offerings and customer experience.

• Send occasional updates, offers, or newsletters (only if you opt in).

• Comply with legal or tax obligations.

c. Data Security

We use secure systems and SSL encryption to protect your personal information.

Payment data is handled by trusted third-party processors (e.g., Square, Wix) that meet industry security standards.

Your information is never sold, rented, or shared with unaffiliated third parties.

d. Cookies and Website Analytics

Our website may use cookies or analytics tools to understand browsing behavior and improve

your experience. You can disable cookies through your browser settings if preferred.

e. Access and Updates

You may request to update or delete your information at any time by contacting info@velvetmorning.ca.

We will comply within reasonable timeframes, except where retention is required by law (e.g., accounting records).

Our website may contain links to third-party sites (such as social media or payment gateways).

We are not responsible for the privacy practices of those external sites.

10. Liability Disclaimer

• By purchasing from Velvet Morning, you acknowledge that consumption of food carries inherent risk.

• Velvet Morning is not liable for allergic reactions, adverse effects, or damages resulting from misuse, delayed consumption, or storage beyond recommended time.

• All products are made in compliance with Alberta Health Services food safety standards.

• To the extent permitted by law, Velvet Morning’s total liability shall not exceed the total price paid for the order in question.

11. Intellectual Property

All images, text, logos, menu descriptions, and packaging designs are the exclusive property of Velvet Morning. They may not be copied, reused, or reproduced without written consent.

 

12. Force Majeure

Velvet Morning is not responsible for delays or cancellations caused by events beyond our control

- including but not limited to weather disruptions, supplier shortages, power failures, or natural disasters.

13. Governing Law

These Terms & Conditions are governed by the laws of the Province of Alberta, Canada.

Any disputes will be handled in the courts of Calgary, Alberta.
